However, I'm still concerned about the financial consequences of a divorce. What's the best way of handling this situation? Well, I usually recommend that the spouses consider some type of postnuptial agreement. It may actually help avoid a divorce. Now let me explain how this works. Well, one of the causes of divorce is financial disagreements. In fact, that's one of the top three reasons for divorce after adultery and abuse. Some financial issues can actually be resolved with a postnuptial agreement which in turn may save the marriage. Now, let me explain what a postnuptial agreement is. This is basically a contract between spouses that's signed after a marriage has taken place. This agreement would stipulate the separation of marital assets in the event of divorce. It basically states who is going to get what in the event of divorce. It can also address issues related to alimony. By resolving these issues in a postnuptial agreement it may actually help take the financial pressure off of a strained marriage, the financial disagreements, which allows the parties to focus on reconciliation. Of course, in the event you're not able to reconcile, you still have a postnuptial agreement that can be enforced in a divorce proceeding which makes the entire process much easier, faster, less stressful, and less expensive. However, keep in mind that the postnuptial agreement must meet certain special legal requirements. Otherwise it may be deemed to be invalid and could be thrown out of court and you would've wasted your time and money.
