The Carbolic Smoke Ball Case - 1892.

In this video, you will learn the story of the landmark legal case of Carlill v The Carbolic Smoke Ball Company. In late 1891, the Russian Flu pandemic was raging in England and people were doing whatever they could to protect themselves from it. All manner of miracle quack cures were being sold to a terrified public by unscrupulous companies who were exploiting the public's fear of what the press was dubbing "the influenza fiend." One such company was The Carbolic Smoke Ball Company, based off Hanover Square in London. They offered a rubber ball with a tube attached to it which was to be inserted into the nostril, the ball was to be squeezed and this would then send a puff of acidic smoke up the nose of the user. This, so the company assured people, would then flush colds and flu out of the body and so protect them from the dreaded influenza. Indeed, so confident was the Carbolic Smoke Ball Company in the efficacy that they offered a reward of £100 to anyone who, having used the ball as prescribed, went on to develop influenza. Mrs Louisa Carlill, of West Dulwich, was one of thousands of people who, In November, 1891, read the advert and was tempted by the offer to give the Carbolic Smoke Ball a go. So, she went out and bough one, took it home, and for the next two months she puffed, sniffed and sneezed her way into what she was convinced would be a flu free new year. But when, in January, 1892, she came down with the flu, Mrs Carlill's husband wrote to the company and asked them to cough up the £100. When they refused, she took them to court, and the landmark legal case of Carlill v The Carbolic Smoke Ball Company began.
