Debate: Originalism vs. Living Constitution

September 15, 2016: The Texas Law Federalist Society hosted a Constitution Day debate about constitutional theory Professor Vladeck is the newest Constitutional Law professor at the University of Texas School of Law. His teaching and research focus on federal jurisdiction, constitutional law, and national security law. A 2004 graduate of Yale Law School, Vladeck clerked for the Honorable Marsha S. Berzon on the U.S. Court of Appeals for the Ninth Circuit, and the Honorable Rosemary Barkett on the U.S. Court of Appeals for the Eleventh Circuit. While a law student, he was Executive Editor of the Yale Law Journal and the Student Director of the Balancing Civil Liberties & National Security Post-9/11 Litigation Project. Professor Vladeck is now a nationally recognized expert on the role of the federal courts in the war on terrorism, and his prolific and widely cited scholarship has appeared in an array of legal publications—including the Harvard Law Review and the Yale Law Journal — and his popular writing has been published in forums ranging from the New York Times to BuzzFeed. Professor Sachs is a scholar of civil procedure, constitutional law, Anglo-American legal history, and conflict of laws. His research spans a variety of substantive topics, focusing on the history of procedure and private law and its implications for current disputes. His research interests include federal jurisdiction, constitutional interpretation, sovereign immunity, and the legal status of corporations. He received his J.D. in 2007 from Yale Law School, where he was executive editor of the Yale Law Journal and served both as executive editor and articles editor of the Yale Law & Policy Review. Sachs clerked for Chief Justice John G. Roberts Jr. during the 2009-2010 Supreme Court term and clerked for Judge Stephen F. Williams on the U.S. Court of Appeals for the D.C. Circuit, prior to joining Mayer Brown.
